Merger support in the water sector
Under the special merger regime in the water sector, the CMA needed to assess if the acquisition of Bournemouth Water by Pennon (owner of South West) would result in prejudice in Ofwat’s use of comparators.
How we did it
CEPA’s work focused on loss of comparator analysis in wholesale (benchmark and precision), retail, SIM and ODIs. CEPA staff supported Ofwat with modelling, response drafting and provided witness statements at CMA hearings.
What we found
Following the analysis conducted, the CMA cleared the merger between South West Water and Bournemouth Water.
